INTRODUCTION:
This CALIFORNIA CONSUMER PRIVACY ACT NOTICE (“CCPA Notice”) supplements and expands the information contained in Mindful Age’s Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this CCPA Notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”) and any terms defined in the CCPA have the same meaning when used in this CCPA Notice. For the avoidance of doubt, our Privacy Policy is incorporated by reference, and any terms used that are not defined in this CCPA Notice or in the CCPA, shall have the meaning assigned to them in our Privacy Policy.
This CCPA Notice is being provided to inform you of, among other things, how we collect, use, and share your personal information that we may collect from you or that you may provide to us through (i) our Website or (ii) Channels, and the rights you have with respect to your personal information.

This CCPA Notice is effective on the Effective Date and has either been reviewed, updated, or reviewed and updated, as of the date or dates set forth at the top of this CCPA Notice. By accessing our Website and/or Channels, you agree to the terms of this CCPA Notice. We reserve the right to update, revise, and/or modify this CCPA Notice at any time and at our sole discretion. Your continued use of our Website or Channels shall constitute your acceptance of the amended CCPA Notice. The amended CCPA Notice supersedes all previous versions. INFORMATION WE COLLECT:
For the purposes of this CCPA Notice, the term “personal information” shall have the meaning ascribed to it under the CCPA. The CCPA defines “personal information.” as any “information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” Sensitive personal information is a subset of personal information, denoted with an Asterix (“*”), below. Personal information does not include (i) de-identified or aggregate consumer information; (ii) publicly available information; (iii) lawfully obtained, truthful information that is a matter of public concern; (iv) or information expressly excluded from the scope of the CCPA.

The Mindful Group does not and will not sell aggregated information, including information that is defined as personal information, about our Users, which specifically includes California consumers. We may use or disclose the personal information we collect and, over the prior twelve (12) months, have used, or disclosed the personal information we have collected, for a “business purpose” or “commercial purpose” (as defined under the CCPA), for the reasons set forth in the Use of Information section of our Privacy Policy. The Mindful Group will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
SHARING PERSONAL INFORMATION:
As mentioned above, Mindful Age does not and will not sell aggregated information, including information that is defined as personal information, about our Users, which specifically includes California consumers. We, however, may share your personal information by disclosing it, for a business or commercial purpose, to third parties that provide services on our behalf to support our business, who are contractually obligated to keep personal information confidential and to use it solely for the purposes for which we disclose it, including our website administrators, mailing vendors, and analytical service providers. PRIVACY FOR CONSUMERS UNDER THE AGES OF 13 AND 16:
As stated in Privacy For Children Under The Age Of 13 section of our Privacy Policy, our Website is designed for a “general audience” and is not intended for use by children under 13 years of age. We do not knowingly collect personal information from children under 13 years of age, unless such information has been obtained in accordance with COPPA. YOUR RIGHTS AND CHOICES:
In addition to those rights set forth in the Choices About How We Use And/ Or Disclose Your Information section of our Privacy Policy, the CCPA provides consumers with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
RIGHT TO KNOW AND DATA PORTABILITY
You have the right request that we provide you with access to the information to you about our collection and use of your personal information over the past twelve (12) months (the “right to know”). Once we receive your request and confirm your identity, as set forth in Exercising Your Rights to Know or Delete, we will disclose to you:

The categories of sources for the personal information we collected about you.
Our business or commercial purpose for collecting that personal information.
The categories of third parties with whom we share that personal information.

RIGHT TO DELETE
You have the right to request that we delete any of your personal information that we have collected directly from you or from a third party, subject to certain exceptions. Once we receive and verify your identity, as set forth in Exercising Your Rights to Know or Delete, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request or not delete some of your personal information, if retaining the information is necessary for us or our service provider(s) to:

Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
Comply with a legal obligation.
Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.
EXERCISING YOUR RIGHTS TO KNOW OR DELETE

Only you, or someone legally authorized to act on your behalf (an “Authorized Agent”), may make a verifiable consumer request to know or delete related to your personal information. [If you, or your Authorized Agent, submits a request via our Web Form, we a two-step process to verify your intention to delete your personal data. You may also make a request to know or delete on behalf of your child by any of the methods set forth in this Exercising Your Rights to Know or Delete.
You may only submit a verifiable consumer request to know and data portability TWICE WITHIN A TWELVE (12)-MONTH PERIOD. Your verifiable consumer request must:
Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.
RESPONSE TIMING AND FORMAT
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact [info@mindfulage.com and/or 781-987-4107]. We will attempt to respond to a verifiable consumer request within forty-five (45) days of receiving such request. If we require more time, we will inform you of the reason and extension period in writing.
We will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the twelve (12)-month period preceding our receipt of your verifiable consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
NON-DISCRIMINATION
We will not discriminate against you for exercising any of your rights under the CCPA. Unless permitted by the CCPA, we will not:
Deny you services;
Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties;
Provide you a different level or quality services; or
Suggest that you may receive a different price or rate for services or a different level or quality of services.
DESIGNATING AN AUTHORIZED AGENT
You can authorize your Authorized Agent to exercise your rights under the CCPA by registering them with the California Secretary of State or pursuant to a power of attorney. If you authorize an Authorized Agent to exercise your rights under the CCPA, we may require your Authorized Agent to submit proof of identity and authorization. As stated in Exercising Your Rights to Know or Delete above, we may deny a request from your Authorized Agent if we cannot verify its authority to make such requests on your behalf.
